1. Acceptance of Terms

By accessing or using CaptureFlow ("the Service"), operated by Web3 Doers Krystian Koronowski, located at 23 Lutego 4/6/27, 61-741 Poznan, Poland (Registry number: PL7792306496), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

CaptureFlow is an AI-powered content creation platform that helps founders, executives, and professionals build their personal brand on LinkedIn. The Service includes:

  • AI-guided video and audio recording studio
  • AI-powered content generation (text posts, scripts, infographics, carousels)
  • Content strategy creation and management
  • Post scheduling and publishing to LinkedIn
  • Content analytics and performance tracking
  • Team and agency workspace management with whitelabel capabilities

3. Account Registration

To use the Service, you must:

  • Create an account using a valid email address, Google account, or LinkedIn account
  • Provide accurate and complete registration information
  • Be at least 18 years of age
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account.

4. LinkedIn Integration

By connecting your LinkedIn account to CaptureFlow:

  • You authorize us to access your LinkedIn profile data for content strategy generation
  • You authorize us to publish content to LinkedIn on your behalf only when you explicitly approve it
  • You can disconnect your LinkedIn account at any time from Settings
  • You remain responsible for all content published to your LinkedIn account through our Service
  • You agree to comply with LinkedIn's User Agreement and Professional Community Policies

5. Content and Intellectual Property

Your Content:

You retain ownership of all content you create, upload, or generate using CaptureFlow, including recordings, posts, documents, and images.

AI-Generated Content:

Content generated by our AI tools is created for your use. You are responsible for reviewing, editing, and approving all AI-generated content before publishing.

Our Platform:

All CaptureFlow platform content, including software, design, logos, and documentation, is our intellectual property and may not be reproduced without written consent.

License to Us:

By uploading content to CaptureFlow, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.

6. Acceptable Use

You agree not to:

  • Use the Service to generate spam, misleading, or harmful content
  • Violate LinkedIn's terms of service or any applicable laws
  • Attempt to gain unauthorized access to other users' accounts or data
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to harass, defame, or infringe on others' rights
  • Exceed reasonable usage limits or abuse AI generation features
  • Share your account credentials with unauthorized third parties

7. Workspace and Team Features

  • Workspace Owners are responsible for managing their workspace, including member permissions and billing
  • Agency Plans allow management of multiple client workspaces with whitelabel branding
  • Members must comply with workspace-level policies set by the owner
  • Removing a member revokes their access to all workspace data

8. Subscription and Billing

  • Subscriptions are managed through Stripe and billed according to your selected plan
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period

  • We reserve the right to change pricing with 30 days' notice

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy at https://captureflow.ai/privacy. By using the Service, you consent to the collection and use of your data as described therein.

10. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted access
  • We may perform maintenance, updates, or modifications that temporarily affect availability
  • We are not liable for downtime caused by factors beyond our control

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

AI-generated content is provided as suggestions. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You are solely responsible for reviewing and approving all content before publishing.

12. Limitation of Liability

To the maximum extent permitted by law, CaptureFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CaptureFlow and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

14. Account Termination

  • You may delete your account at any time from Settings
  • We may suspend or terminate your account for violation of these Terms
  • Upon termination, your data will be deleted in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination (limitation of liability, indemnification) shall survive

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved in the courts of Poznan, Poland.
